Permission
   Only the copyright owner can give permission to copy. On January 1, 1978, the law drastically changed who owned the copyright in commissioned photos. The customer (absent any other agreement between the customer and the photographer) owns commissioned photos taken before that date. Requests made by the customer to copy those photos can be validly honored. Since the 1978 change the photographer is the default owner for all of these photos. Of course, the owner is the studio or other employer if the photographer was an employee or signed a work for hire agreement.

   It is illegal to reproduce photographs taken by a professional photographer or other copyrighted material without the permission of the copyright owner even if it does not include a © symbol or wording.

   As with any image, your possession of a copy of an image does not give you any rights to use it as you wish. Only the copyright owner, or the owner's legal agent, can give you permission to copy, distribute, or publicly display the image ©
